1. DEPOSITS
1.1 Your booking will be confirmed on 20% of the total cost of the package as deposit.
1.2 Balance of the total package cost is required 30 days before departure date.
1.3 For bookings less than 30 days before the departure date, full payment is required within 48 hours of booking.
1.4 For bookings less than 7 days before the departure date, full payment is required at time of booking.
1.5 Payments to other operators (eg. charter flights), will be advised to you when the booking is confirmed.
2. PAYMENTS

3. VESSEL
Charter vessel is “Moana 3”. In the event of “Moana 3” not being available due to some unforseen circumstances then a similar replacement vessel will be engaged.
4. CREW
All endeavours will be used to engage any nominated crew member/s. If any nominated crew member/s becomes unavailable up to the date of departure, then a suitable replacement will be substituted.
5. START AND FINISH DATES
While all endeavours will be made to start and finish the charter on time it is possible that due to weather or circumstances beyond our control that there will be delays. Big Fish Down Under nor Moana Fishing Charters will not be responsible for any losses caused by such unavoidable delays. One (1) day grace will be allowed to us on the start of the charter.
6. CANCELLATIONS
6.1 If made 120 days or more before the departure date, all monies paid will be refunded (less $200.00 administration charge).
6.2 If made within 120 days before the department date, then a refund will only be made if the charter time can be resold at the same price. If only a partial resale is obtained, then the refund will be on a pro-rata basis.
6.3 We will make every endeavour to resell any cancelled charter time and will accept a resale by you if the buyer is suitable to us.
6.4 If the charter is cancelled by Big Fish Down Under / Moana Fishing Charters prior to departure, all monies will be refunded in full
7. ITINERARIES
We reserve the right to alter itineraries because of natural disasters, weather conditions, government regulations and other circumstances beyond our control.
8. PRICES
All prices are in Australian dollars unless otherwise stated.
9. LIABILITY
Moana Fishing Charters & Big Fish Down Under accepts no liability for any loss or damage either in contract or in port, or for any additional expenses or inconveniences caused by any events outside of its control. It will be indemnified and kept indemnified by you in respect to any such loss or damage.
10. JURISDICTION
The parties agree that the laws of the State of Queensland and the Commonwealth of Australia shall apply to all matters relating to this Agreement.
11. REPRESENTATIONS
Any representations sought to be relied upon must be in writing.
12. INSURANCE
It is strongly recommended that you take out travel insurance to cover any losses either directly or indirectly connected to this Agreement. In particular, to include medical insurance, loss of baggage and personal items and loss through cancellation and delays.
